Terms of Service

These terms govern your use of 39bases. By creating an account or using the service you agree to them. If you disagree with any part, don't use the service.

What 39bases is

39bases is a website analytics service. You add a small JavaScript snippet to sites you own or operate; we record pageviews, referrers, and outbound clicks; you see aggregated stats in your dashboard. We do not use cookies, store IP addresses, or identify individual visitors. See our Privacy Policy for full data practices.

Your account

You sign in via magic link to the email address you provide. You're responsible for keeping that email account secure. If you lose access to your email you lose access to 39bases — email hello@39bases.com from a verifiable alternate address and we'll help.

One account per person or organization. Don't share credentials. Don't impersonate someone else. We may suspend accounts that appear to violate these terms.

Acceptable use

Don't:

• Install the snippet on websites you don't own or have permission to instrument.
• Attempt to deanonymize visitors, correlate visitor hashes across sites, or reverse-engineer the hashing scheme.
• Use the service to track sites that violate any applicable law in your jurisdiction.
• Overload, probe, scan, or test the vulnerabilities of any system without explicit written permission.
• Resell access to the service or sublicense it without our written agreement.

Pricing and billing

The Free plan is free forever, subject to the limits shown on the pricing page. The Pro plan is $14 per month or $99 per year, billed in advance and auto-renewing on the same day each period until canceled. Stripe handles all payment processing.

Prices can change. If we change the price of an existing plan we'll email all affected customers at least 30 days in advance. Existing customers may be grandfathered at the price they signed up at, at our discretion. Promotional discounts and coupons apply only to the periods stated.

Cancellation and refunds

You can cancel any time from your billing page or by emailing us. When you cancel, your subscription stays active through the end of the current paid period — you keep Pro access until that date — and then your account reverts to Free with no further charges.

Refunds:

• Monthly plans: we do not refund partial months. Cancel and use the remainder of the period.
• Annual plans: if you cancel within 14 days of the initial purchase or renewal, email us for a full refund. After 14 days, no prorated refunds — use the remainder of the year.
• Service failure: if 39bases is materially broken for an extended period and we can't fix it, we'll refund the affected portion of your current period regardless of plan type.

Service availability

We aim for high availability but don't offer an SLA at this stage. The service is provided "as is" without warranties of any kind. Scheduled maintenance, infrastructure provider outages (Railway, Vercel, Stripe), and unforeseen incidents may cause downtime. We'll communicate significant outages via email and on our status messaging.

Data ownership and portability

You own the analytics data collected for your sites. We process it on your behalf. You can export your data at any time — the dashboard provides CSV export on the Pro plan, and you can request a full data export by emailing us.

We won't sell your data, share it with advertisers, or use it for any purpose other than operating the service for you.

Termination

You can delete your account at any time by emailing hello@39bases.com from the registered address. We'll process the deletion within 14 days; all account data, sites, and event records are removed.

We may suspend or terminate accounts that violate these terms, fail to pay after a 14-day grace period, or appear to be engaged in fraud or abuse. We'll email before terminating except where doing so would risk further harm.

Liability

To the extent permitted by law, our total liability for any claim related to 39bases is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, lost data, or lost profits. The service is provided "as is."

Changes to these terms

We may update these terms. For material changes we'll email active customers at least 14 days in advance and update the "Last updated" date at the top. Continued use after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law rules. Disputes shall be resolved in the state or federal courts located in California.
